1. General Provisions

By using the elastix.group website, submitting an inquiry, quotation request, partnership application, or order, you confirm that you have read these Terms and agree to their application to the extent that they relate to the relevant service or order.

If the terms of a specific order, invoice, contract, technical specification, warranty document, or written offer differ from these general Terms, the terms of that specific document shall apply to the relevant order.

2. Use of the Website

The website is intended to provide information about Elastix products, stretch ceilings, profile systems, lighting solutions, installation services, and partnership opportunities, as well as to accept inquiries and orders.

You agree not to use the website for unlawful purposes, attempt to compromise its security, interfere with its operation, or use automated means for the unlawful copying of or damage to the website or its data.

3. Products and Services

Elastix may offer stretch ceiling materials, profiles, inserts, lighting and ventilation components, professional tools, measurement, production, delivery, installation, and other related services.

Product and service availability, technical specifications, colors, dimensions, configurations, and delivery times may vary depending on the specific order, stock availability, and manufacturer conditions.

4. Website Calculator, Prices, and Preliminary Quotations

Prices shown on the website, calculator results, and automatic or preliminary estimates are for informational and approximate purposes unless expressly stated otherwise and do not constitute a final commercial offer or binding final price.

The final price may depend on actual dimensions, ceiling geometry, number of corners, selected material and profile, lighting, condition of the main ceiling and walls, installation complexity, location, additional work, and other technical conditions.

The final price is confirmed after measurement, clarification of technical details, or written confirmation of the order.

5. Measurement and Order Confirmation

Installation work may require an on-site measurement. The customer is responsible for providing accurate information about the property, address, access, and technical requirements.

An order is considered confirmed once the parties have agreed on its main terms, including the type of product or service, dimensions or quantity, price, payment terms, and, where applicable, the completion or delivery timeframe.

6. Payment Terms

The payment method, amount of any advance payment, and deadline for payment of the balance are determined in the specific order, invoice, contract, or written offer issued by Elastix.

If the order includes custom-sized production or specially ordered products, production may begin only after receipt of the required advance payment and final confirmation of the technical details.

7. Production, Delivery, and Installation

Production, delivery, and installation timeframes are determined separately for each order. The stated timeframe may be adjusted in the event of technical changes, supply delays, an unprepared site, or other circumstances outside Elastix’s reasonable control.

The customer must provide access to the premises at the agreed time and ensure the working conditions necessary for installation.

8. Order Changes and Cancellation

The possibility of changing or cancelling an order depends on the stage of its execution. If a custom-sized product has already been cut, welded, manufactured, ordered, or otherwise customized, changes or cancellation may be restricted.

In the event of cancellation, any refundable amount, where applicable, will be determined taking into account work already completed, materials already used or specially ordered, and consumer rights established by law.

9. Warranty

The availability, duration, coverage, and exclusions of any warranty are determined by the terms applicable to the specific product, order, contract, invoice, or warranty document.

Unless otherwise stated in the specific warranty terms, the warranty generally does not cover damage caused by improper use, third-party intervention, mechanical damage, external thermal or electrical impact, unauthorized dismantling or repair, or use contrary to the instructions of the manufacturer or Elastix.

10. Color, Texture, and Appearance

Photographs, 3D images, colors, material samples, and design visualizations displayed on the website are provided for illustrative purposes. The actual color or appearance of a product may vary slightly from its digital image due to screen settings, lighting, production batch, or material characteristics.

Where precise color or texture is important, we recommend making the final selection based on a physical sample.

11. Customer Responsibilities for Installation

Where applicable, the customer is responsible for:

• providing accurate measurements or allowing an Elastix specialist to perform the measurement,
• informing us about concealed wiring, pipes, ventilation, and other engineering systems,
• ensuring that walls and fixing areas are in a sufficiently suitable technical condition,
• agreeing in advance on the placement of lighting, curtain tracks, ventilation, and other built-in elements,
• providing access to the site and safe working conditions.

If previously undisclosed technical issues are discovered during the work, additional work or revision of the price and timeframe may be required after informing the customer in advance.

12. Partners and B2B Orders

Separate pricing, supply, production, payment, and technical conditions may apply to partners, installers, designers, construction companies, resellers, and other B2B customers.

Access to a partner account or special price list does not by itself create an exclusive, agency, representation, or franchise relationship unless such a relationship is established by a separate written agreement.

13. Intellectual Property

Trademarks, names, logos, designs, texts, photographs, graphics, catalogs, videos, and other content available on the website belong to Elastix or are used with the permission of the relevant rights holders, unless otherwise indicated.

Commercial reproduction, distribution, or use of all or a substantial part of the content without prior written permission is prohibited, except where permitted by law.

14. Limitation of Liability

Elastix is liable within the limits established by applicable law and the relevant contract. General information available on the website does not replace a technical inspection of the property, professional measurement, or a written technical proposal prepared for a specific project.

Nothing in this section limits any rights or liability that cannot be limited under the applicable legislation of the Republic of Armenia.

15. Third-Party Services and Links

The website may contain links to or integrations with third-party websites, payment, mapping, social media, communication, or other services. The terms and policies of the relevant third party may apply to your use of such services.

16. Personal Data Protection

The processing of personal data provided through the website is also governed by Elastix’s Privacy Policy. We recommend reviewing that document when using the website.

17. Force Majeure and Circumstances Beyond Reasonable Control

A party shall not be considered in breach of its obligations to the extent that performance is prevented or delayed by circumstances beyond its reasonable control, unless otherwise provided by applicable law or the relevant contract.

18. Governing Law and Dispute Resolution

These Terms are interpreted and applied in accordance with the legislation of the Republic of Armenia. The parties shall seek to resolve possible disputes first through negotiations and written communication.

If a dispute cannot be resolved by agreement, it shall be resolved in accordance with the procedure established by the legislation of the Republic of Armenia. These Terms do not limit any mandatory consumer rights provided by law.

19. Changes to the Terms

Elastix may update these Terms from time to time to reflect changes to the website, services, legislation, or business processes. The updated version will be published on this page with the “Last updated” date.

If a change relates to an already confirmed order, it does not automatically amend the previously agreed terms of that order unless the parties agree otherwise in writing or applicable law provides otherwise.
